Terms and Conditions

§ 1 Scope and Customer Information
The following terms and conditions (T&Cs) govern the contractual relationship between Institut für Naturkosmetik Prof. Kruck GmbH & Co. KG and consumers and entrepreneurs purchasing goods from our myrto Naturkosmetik shop. Any terms and conditions conflicting with or deviating from these T&Cs will not be recognized by us. The contractual language is German.

§ 2 Conclusion of the Contract

1. The offers presented online are non-binding invitations for you to order goods.

2. You may place one or more products in the shopping cart. During the ordering process, you will enter your details and preferences regarding payment methods, delivery options, etc. By clicking the order button, you submit a binding offer to conclude a purchase contract.

3. We are entitled to accept your offer within one business day by sending an order confirmation via email. If the aforementioned period expires without acceptance, your offer is considered rejected, and you are no longer bound by it.

§ 3 Customer Information: Storage of Your Order Data
Your order details, including contract specifics (e.g., type of product, price, etc.), are stored by us. We will send you the terms and conditions, which you can also access on our website after the contract is concluded. Registered customers can view their past orders in the customer login area ("My Account").

§ 4 Customer Information: Correction Notice
You can correct your entries at any time before placing your order by using the delete key. We provide additional correction options throughout the ordering process. You may cancel the ordering process entirely by closing the browser window at any time.

§ 5 Retention of Title
The purchased item remains our property until it has been paid in full.

§ 6 Statutory Warranty Rights

1. Warranty Rights:
   Statutory warranty rights apply to our goods.

2. Shortening of the Limitation Period for Used Goods (Consumers):
   The limitation period for warranty claims for used goods is reduced to one year.
   This does not apply to claims for damages, claims related to defects that we have fraudulently concealed, or claims arising from a guarantee for the condition of the goods, if applicable. For these exceptions, the statutory limitation periods apply. If a guarantee period applies, the longer period in favor of the guarantee holder applies.

3. Limitation of Warranty Rights for Entrepreneurs:
   Warranty claims for defects in the purchased item lapse one year after the transfer of risk.
   This rule excludes the following claims:

   • Claims for damages
   • Claims arising from fraudulently concealed defects
   • Claims based on guarantees, if applicable
   • Recourse claims under §§ 445a, 478 BGB
   • Claims for defects in construction materials and components used according to their intended purpose in a building and causing its defectiveness.
     Statutory limitation periods apply to these exceptions. If a guarantee period is granted, the longer period in favor of the buyer applies.

§ 7 Limitation of Liability
We exclude liability for minor negligent breaches of duty, provided these do not involve essential contractual obligations, damages resulting from injury to life, body, or health, guarantees, or claims under the Product Liability Act (ProdHaftG). The same applies to breaches of duty by our agents or legal representatives. Essential contractual obligations include, in particular, the obligation to hand over the item and transfer ownership of it to you, as well as ensuring the item is free of material and legal defects.

§ 8 Jurisdiction for Business Customers
The exclusive place of jurisdiction for all disputes arising from this contract is our business location if you are a business customer.
