§ 1 Scope, Customer Information

The following general terms and conditions (GTC) govern the contractual relationship between Institut für Naturkosmetik Prof. Kruck GmbH & Co. KG and the consumers and businesses who purchase goods through our myrto Naturkosmetik shop. We do not accept any terms and conditions that conflict with or deviate from our terms and conditions. The contractual language is German.

§ 2 Conclusion of Contract

(1) The offers on the Internet represent a non-binding invitation to you to order goods.

(2) You can put one or more products in the shopping cart. During the ordering process, you enter your data and requests regarding payment method, delivery terms, etc. Only when you click the order button do you make a binding offer to conclude a purchase contract.

(3) We are entitled to accept your offer within 1 working day by sending an order confirmation by email. After the deadline specified in sentence 1 expires without result, your offer is deemed to have been rejected, i.e. you are no longer bound by your offer.

§ 3 Customer information: Storage of your order data

We will save your order with details of the concluded contract (e.g. type of product, price, etc.). We will send you the terms and conditions, but you can also access the terms and conditions at any time after the contract has been concluded via our website. As a registered customer, you can access your past orders via the customer login area (My Account).

§ 4 Customer information: Correction notice

You can correct your entries at any time before placing your order using the delete key. We will inform you about further correction options as you go through the ordering process. You can also end the ordering process completely at any time by closing the browser window.

§ 5 Retention of Title

The purchased item remains our property until full payment has been made.

§ 6 Statutory liability rights for defects

(1) Liability for defects
There are statutory liability rights for defects in our goods.

(2) Reduction of the limitation period for used goods sold to consumers
It is agreed to shorten the limitation period for claims for defects in used goods to one year.
Excluded from this agreement are claims for damages, claims for defects that we have fraudulently concealed, and claims arising from a guarantee that we may have given for the quality of the item. The statutory time limits apply to these excluded claims. If a guarantee period exists, the longer period applies in favor of the guarantee holder.

(3) Limitation of liability rights for defects (warranty) towards entrepreneurs
Your warranty claims due to defects in the purchased item expire one year after the transfer of risk. The following claims are excluded from this regulation
- for damages
- due to fraudulently concealed defects
- from any guarantee given
- recourse according to §§ 445a, 478 BGB
- due to defects in building materials and components which have been used for a building in accordance with their usual purpose and which have caused the defectiveness of the building.
The statutory limitation periods apply to these excluded claims. In the event of a guarantee period, the longer period applies in favor of the buyer.

§ 7 Limitation of Liability

We exclude liability for slightly negligent breaches of duty, provided that these do not concern essential contractual obligations, damages resulting from injury to life, body or health, guarantees or claims under the Product Liability Act (ProdHaftG). The same applies to breaches of duty by our vicarious agents and our legal representatives. Essential contractual obligations include in particular the obligation to hand over the item to you and to give you ownership of it. Furthermore, we must provide you with the item free of material and legal defects.

§ 8 Commercial Jurisdiction

The exclusive place of jurisdiction for all disputes arising from this contract is our place of business if you are a merchant.

Legal obligation to provide information to promote dispute settlement procedures

The EU Commission provides a platform for out-of-court dispute resolution. This gives consumers the opportunity to initially settle disputes relating to their online order out of court.
